Delaware's Equal Accommodations Law uses the ADA wording, dogs only, and requires public accommodations to admit a person training a service animal. Delaware has no fake service dog law (a 2024 bill died in committee), no ESA housing statute and no service dog tag. Only guide dogs get a free license.
Who counts as a service animal in Delaware?
"'Service animal' means a dog individually trained to do work or perform tasks for the benefit of a person with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability" (6 Del. C. 4502). That is the ADA wording, and there is no miniature horse provision in state law.
Delaware's criminal interference law uses a broader definition: "'service dog' means any guide dog, signal dog, or other animal individually trained to do work or perform tasks for the benefit of an individual with a disability" (16 Del. C. 3056F).
Public places in Delaware, including hotels and restaurants
"A place of public accommodation must permit service animals as follows: a. An individual with a disability accompanied by a service animal in any place of public accommodation" (6 Del. C. 4504). Refusing someone on account of disability is an unlawful practice, handled through the chapter 45 complaint process. Intentionally interfering with a service dog is a class B misdemeanor, and injuring one is a class A misdemeanor (16 Del. C. 3056F).
The federal ADA applies in Delaware too. When it is not obvious what the dog does, staff may ask only whether it is a service animal required because of a disability and what task it has been trained to perform. Service dogs in training in Delaware
Yes, as written. A place of public accommodation must permit "An individual training a service animal to be used by persons with disabilities accompanied by a service animal in any place of public accommodation" (6 Del. C. 4504). There is no professional, school or ID requirement.
One caution: the text speaks of a trainer "accompanied by a service animal", so it does not spell out whether an animal still in training qualifies. Carry yourself as a trainer, keep training sessions short and be ready to leave if asked. See service dogs in training.
Is there a Delaware service dog registration or tag?
No. Delaware has no service dog ID or registry. The Office of Animal Welfare issues a free "metal license tag or an alternative method for identification" to a qualifying guide dog, but that is its ordinary dog license. The fee waiver covers only "a seeing-eye, lead, or guide dog" or a dog that served in the armed forces (16 Del. C. 3042F); other service dogs are not named.
Private registries, ours included, are voluntary and add no rights.
Housing: service dogs and ESAs in Delaware
Delaware has no ESA housing statute. The Delaware Fair Housing Act (6 Del. C. chapter 46) has no animal-specific provision, so disability accommodation applies generally. SB 219 of 2024 would have added housing rules for assistance animals but was not enacted.
Federal housing law shifted in 2026. HUD withdrew its 2020 assistance animal guidance, and a May 22, 2026 memo says its fair housing office will find reasonable cause in animal cases "only for those cases involving animals trained to provide disability-related assistance." The Fair Housing Act itself did not change and private lawsuits remain possible, so Delaware law matters more than before. See ESA letters and housing after HUD's 2026 change.
ESA letters in Delaware
Delaware sets no rules for ESA letters. The federal documentation standard is thin after 2026: no current HUD document says what a landlord may ask for, and the older 2004 HUD and DOJ Joint Statement, still posted, speaks of reliable disability-related information that shows the link between the disability and the need.

Employment in Delaware
Public-access rules do not govern the workplace. Employment falls under Title I of the ADA: you request an accommodation, and when the disability or need is not obvious your employer may ask for reasonable documentation, which a store may not. EEOC settlements show a trained service dog can be a reasonable accommodation. Put your request in writing. More in service dogs at work.
Misrepresentation penalties in Delaware
Delaware has no law penalizing misrepresentation of a service animal. SB 219 (152nd General Assembly, 2024) would have made it a $500 civil penalty, including fitting a non-service animal with "a harness, collar, vest, or sign", with later offenses a misdemeanor. It stayed in committee, and the legislature's record says "The General Assembly has ended, the current status is the final status." No 2025 or 2026 successor was confirmed.

Where to file a complaint in Delaware
- A business, hotel, restaurant or government office refused your service dog: report it to the U.S. Department of Justice through the online form linked from its ADA complaint page.
- Housing: Fair Housing Act complaints go to HUD, which now finds cause in animal cases only for trained animals. A private lawsuit is still possible.
- Work: file a charge with the EEOC, generally within 180 calendar days, or 300 days where a state or local agency enforces a similar law.
- State route: refusal in a public accommodation is an unlawful practice under the Equal Accommodations Law, handled through its chapter 45 complaint process. Interfering with a service dog is a misdemeanor.
