An emotional support animal (ESA) helps a person with a disability by being there, not by doing trained tasks. That means it is not a service animal under the ADA, it has no federal right to go into stores or restaurants, and airlines may treat it as a pet. Its real legal home is housing, and since HUD's 2026 change that depends mostly on your state's law and a letter from your own clinician. No registration, vest or ID card changes any of this.
What is an emotional support animal (and what isn't it)?
DOJ describes ESAs this way in its ADA FAQ:
"These terms are used to describe animals that provide comfort just by being with a person. Because they have not been trained to perform a specific job or task, they do not qualify as service animals under the ADA. However, some State or local governments have laws that allow people to take emotional support animals into public places."DOJ ADA service animal FAQ, question 3
California's definition adds a useful detail: an ESA "provides emotional, cognitive, or other similar support to an individual with a disability, and ... does not need to be trained or certified." So an ESA is not a lesser service dog. It is a different thing, defined by a different job. If your dog is individually trained to do a task for a psychiatric disability, it may be a psychiatric service dog instead.
ESAs are not limited to dogs in most of the rules we cover. Cats are common. A few laws are narrower: Arkansas's ESA documentation law covers emotional support dogs only.
Are emotional support animals considered pets?
It depends on who is asking. Under the ADA and in most businesses, yes: an ESA is treated like any other pet. The DOT says airlines "may treat them as pets," Amtrak says an ESA "is subject to the same requirements as a pet," and Walmart's policy welcomes ADA service animals while not allowing pets. In housing, an ESA can be something more than a pet: a reasonable accommodation to a no-pets rule, where federal enforcement, state law and a clinician's letter decide the outcome.
ESA rights in 2026: housing, travel, work, public places
- Housing: the strongest ground, but it moved. HUD withdrew its 2020 assistance animal notice (effective September 17, 2025), and its May 22, 2026 memo says "requests to waive pet policies for untrained ESAs are not" presumptively reasonable. You can still sue privately under the Fair Housing Act, and states such as Colorado (HB26-1045, 2026) protect ESAs in state law. Start with ESA letters for housing.

- Other travel: hotels, rideshare, trains, buses and cruises set their own ESA rules.
- Work: possibly, as an accommodation request. The Job Accommodation Network says "there is an argument that employers might have to consider emotional support animals as an accommodation."

Letters, not registration
ESA registration sites sell a number, a certificate and an ID card. None of it matters to a landlord or an airline. Florida's statute says it outright:
"An emotional support animal registration of any kind, including, but not limited to, an identification card, patch, certificate, or similar registration obtained from the Internet is not, by itself, sufficient information"Florida Statutes 760.27
What housing laws describe is a letter from a licensed provider who knows you, often with conditions: California, Iowa, Montana, Louisiana and Arkansas require a relationship of at least 30 days. HUD's 2026 memo describes "an entire industry" that emerged "to convert pets into emotional support animals." We do not sell or refer letters. Do emotional support dogs need training?
No law we found requires task training for an ESA, and California's definition says an ESA does not need to be trained or certified. But manners still matter in practice. A housing provider does not have to accept a tenancy that "would constitute a direct threat to the health or safety of other individuals" or cause "substantial physical damage to the property of others," and every source we found lets a landlord charge for actual damage an animal causes. And federal housing enforcement now looks at training (see above), which makes a calm, well-behaved animal more important, not less.

Emotional support animals for anxiety
Anxiety is one of the most common reasons people look into ESAs. The legal questions are the same for any condition: is it a disability, and does your clinician find that an animal helps with it? For housing, the Fair Housing Act defines a disability as "a physical or mental impairment which substantially limits one or more of such person's major life activities." If your dog is trained to do something specific when anxiety strikes, such as alerting to an oncoming panic attack, it may be a psychiatric service dog instead. Gear for ESAs, honestly
ESA vests, collars and tags can be genuinely useful as signals: "please ask before petting," "this animal is nervous," "give us space." They are not access tools. California requires anyone who sells a certificate, ID, tag, vest, leash or harness for an ESA to give the buyer a written notice stating:
"(1) The item does not entitle an emotional support animal to the rights and privileges accorded by law to a guide, signal, or service dog. (2) Knowingly and fraudulently representing oneself to be the owner or trainer of any canine licensed as, to be qualified as, or identified as, a guide, signal, or service dog is a misdemeanor violation of Section 365.7 of the Penal Code."California Health and Safety Code 122317(b)

Common questions
Do emotional support animals have public access rights?
Not under federal law. DOJ says ESAs do not qualify as service animals under the ADA, though some state or local laws allow ESAs in some public places.
Can an emotional support animal be a cat?
Yes, under most of the rules we cover. Some state laws are narrower, such as Arkansas, whose ESA documentation law covers dogs only.
Do I need to register my emotional support animal?
No. No law requires ESA registration, and Florida's statute says an internet registration is not, by itself, sufficient information for a landlord.
Can my ESA fly with me for free?

Can a landlord charge pet rent for an ESA?
It depends on the state. California, Virginia, Kentucky, Florida and Wisconsin bar pet fees for assistance animals, while a 2025 federal court decision upheld a pet fee for an ESA. You can be charged for actual damage.
What does ESA mean for a dog?
An emotional support dog is a dog that helps its owner by being there. It is not trained for disability tasks, so it is not a service dog.
